These Terms and Conditions ("Terms") govern your access to and use of prometheanind.com (the "Site"), operated by Promethean Industries ("Promethean," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Description of the Site
The Site provides general information about Promethean's go-to-market strategy, retail and channel development, sales organization and process consulting, manufacturer's representation, and sales enablement services, and allows visitors to contact Promethean or book a consultation. The Site is informational and does not itself deliver consulting services — those are provided under a separate engagement agreement.
2. No Professional Advice; No Guaranteed Results
Content on the Site — including descriptions of our services, market insights, case studies, or examples of past results — is provided for general informational purposes only and does not constitute legal, financial, tax, or other professional advice. Any references to past client outcomes, growth, or revenue are illustrative of individual engagements and are not a guarantee, promise, or prediction of results for any other business. Business, sales, and market outcomes depend on many factors outside Promethean's control, and past performance does not guarantee future results.
3. Eligibility
The Site is intended for business use by individuals who are at least 18 years old and have the authority to engage with Promethean on behalf of a business. By using the Site, you represent that you meet these requirements.
4. Intellectual Property
All content on the Site — including text, graphics, logos, the Promethean name and marks, and the design and layout of the Site — is owned by Promethean Industries or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print Site content for personal, non-commercial reference only. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written consent, except as permitted by law.

Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
Interfere with or disrupt the operation of the Site, including through malware, excessive automated requests, or denial-of-service attacks;
Scrape, harvest, or collect information about other users or the Site's content without authorization;
Submit false, misleading, or fraudulent information through any form on the Site;
Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
6. User Submissions
Any information, feedback, or content you submit through the Site (e.g., through a contact or booking form) is provided voluntarily and is subject to our Privacy Policy. You represent that any information you submit is accurate and that you have the right to submit it. Do not submit confidential or proprietary business information through the Site unless you are prepared for it to be handled as described in our Privacy Policy.
7. Scheduling Tool
The Site uses HubSpot Meetings to book calls. Your use of that tool is also subject to its own terms of service and privacy policy. Promethean is not responsible for the availability or functionality of third-party tools.
8. Third-Party Links
The Site may contain links to third-party websites (including websites of brands, retailers, or partners we represent) that are not owned or controlled by Promethean. We are not responsible for the content, accuracy, or practices of any linked third-party site, and inclusion of a link does not imply endorsement.
9. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT ON THE SITE IS ACCURATE OR COMPLETE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PROMETHEAN INDUSTRIES AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS DO NOT APPLY TO A SEPARATE SIGNED CONSULTING OR REPRESENTATION AGREEMENT, WHICH IS GOVERNED BY ITS OWN TERMS.
11. Indemnification
You agree to indemnify and hold harmless Promethean Industries and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Deschutes County, Oregon, and you consent to personal jurisdiction there.
13. Termination and Access
We may suspend or restrict your access to the Site, at our discretion, for any conduct that we believe violates these Terms or is otherwise harmful to the Site, Promethean, or other users.
14. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Promethean regarding use of the Site.
